These Terms of Service ("Terms") govern your access to and use of the BidBlast platform and related services (collectively, the "Service") provided by BidBlast Inc. ("BidBlast," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

BidBlast provides a real-time live auction bidding platform that enables auctioneers ("Organizers") to host online bidding events and registered participants ("Bidders") to place bids on listed items. BidBlast is a technology platform only; we are not an auctioneer, buyer, or seller of any items listed through the Service.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use the Service. By registering, you represent and warrant that you meet these requirements.

4. Account Registration

You must create an account to access certain features of the Service. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@bidblast.auction if you suspect unauthorized access.

5. Fees and Payment

Access to certain features of the Service requires payment of fees as described on our Pricing page. All fees are quoted in USD and are non-refundable except as required by applicable law or expressly stated in these Terms. Payments are processed securely through Stripe; by submitting payment you also agree to Stripe's terms of service.

6. Organizer Obligations

As an Organizer, you agree to:

  • Accurately describe all items listed for auction
  • Honor winning bids and complete transactions in good faith
  • Comply with all applicable laws and regulations governing auctions in your jurisdiction
  • Not list counterfeit, stolen, prohibited, or illegal items
  • Maintain appropriate licenses or permits required to conduct auction events

7. Bidder Obligations

As a Bidder, you agree to:

  • Place bids only when you genuinely intend to purchase the item at that price
  • Complete payment for items you have won within the timeframe specified by the Organizer
  • Not engage in bid manipulation, shill bidding, or any form of auction fraud

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any portion of the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape, crawl, or spider any content from the Service without our express written consent
  • Use automated bidding tools or bots not provided or authorized by BidBlast
  • Impersonate any person or entity

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of BidBlast Inc. and its licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, express or implied. BidBlast does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by law, BidBlast Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. In no event shall our total liability exceed the amount you paid to BidBlast in the twelve months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.

14. Changes to Terms
